Rethinking how contracts work
Contracts play a critical, yet often overlooked, role in the transition from strategy to practice. They influence how expectations are translated into everyday decisions and actions within organisations and across supply chains. When they work well, contracts promote clarity and responsible behaviour. However, when they do not, even well-designed sustainability strategies remain merely aspirational.
Module 3 focused on diagnosing why contracts fail in practice. This module shifts from diagnosis to improvement - from understanding what goes wrong to identifying where real change can begin.
Rather than turning readers into contract drafters or promoting a single set of model clauses, this module offers practical principles and tools that help contracts function better as instruments for sustainable and responsible business.
Making contracts work better does not require rewriting everything. In many cases, the biggest gains come from recognising and addressing contractual legacy - inherited mindsets, templates and drafting habits that quietly shape how contracts are written and used. Small, targeted improvements can significantly improve implementation and outcomes.
Text box: The tools in this module are primarily intended for improving your organisation’s own contract templates, models, standard terms and other recurring contract texts across the contract stack. Their value lies in scalability, rather than in one-off contract negotiations.
