Module III. Defining the Problem: What is wrong with current contracts?

How to use this module

This module is designed as a diagnostic tool. Rather than teaching you how to draft contracts, it is intended to help you identify issues in existing contracts and related documents that could hinder your sustainability objectives.

You can use this module in three main ways:

1. As a guided reading lens

  • Keep a real contract (and any related Code of Conduct, Supplier Requirements and General Terms and Conditions) at hand. Use the concepts of content and presentation to test whether commitments are clear, realistic and usable in practice.

2. As a discussion tool

  • Use the problem patterns and questions to structure conversations between legal, procurement, sustainability and business teams. The aim is to surface hidden assumptions and misalignments early, before they turn into implementation problems.

3. As preparation for improvement

  • This module prepares you for the practical principles and tools introduced in Module 4. By making problems visible first, it becomes easier to improve contract content, calibrate commitments and strengthen language and information design in a targeted way.

You do not need legal expertise to work with this module. The focus is on how contracts function in practice.
